10th Circ. Shoots Down Xcel Energy Sex Bias Suit

Law360, New York (April 29, 2009, 12:00 AM EDT) -- A federal appellate court has affirmed a lower court's finding that a woman was not discriminated against based on her gender when Xcel Energy Inc. refused to hire her for an entry-level power plant position.

A three-judge panel of the U.S. Court of Appeals for the Tenth Circuit said Tuesday that a lower court was right to reject the gender discrimination claim Susan K. Turner made against Public Service Co. of Colorado, which is now known as Xcel Energy Inc.
