Fed. Circ. Vacates Trademark Board's Vodka Ruling

Law360 (April 29, 2009, 12:00 AM EDT) -- Spirits International NV's attempt to register a trademark for its vodka has found new life, after a federal appeals court on Wednesday overturned an earlier decision that the mark’s association with Moscow is geographically misleading.

The U.S. Court of Appeals for the Federal Circuit vacated and remanded a February decision by the U.S. Patent and Trademark Office’s appeal board that upheld a trademark-examining attorney’s refusal to register the Moskovskaya mark on the grounds that it was “geographically deceptively misdescriptive” under trademark laws.
