Katrina Liability Not Offset By FEMA Funds: Court

Law360 (April 30, 2009, 12:00 AM EDT) -- Travelers Property Casualty Co. cannot offset what it owes Xavier University under an all-risks insurance policy with disaster relief funds that Xavier received from the Federal Emergency Management Agency following Hurricane Katrina, a federal judge has ruled.

Judge Sarah Vance of the U.S. District Court for the Eastern District of Louisiana on Tuesday granted Xavier's motion for partial summary judgment, ruling that “Travelers does not claim that it is entitled to an offset of federal disaster relief funds.”
