Fla. Airport Will Proceed Despite Enviro Risks

Law360 (May 1, 2009, 12:00 AM EDT) -- Construction of a Florida airport will proceed despite the objections of three environmental groups, after a federal appeals court decided on Friday the Federal Aviation Administration’s approval of the project was valid.

Finding the FAA’s decision not “arbitrary, capricious an abuse of discretion” or unlawful, Judge Reena Raggi in the U.S. Court of Appeals for the Second Circuit tossed the claims of the environmental groups.
