4th Circ. Clarifies When EEOC Decisions Become Final

Law360, New York (May 4, 2009, 12:00 AM EDT) -- The U.S. Court of Appeals for the Fourth Circuit has issued a ruling clarifying when an adverse decision from the U.S. Equal Employment Opportunity Commission becomes final for the purpose of filing a civil action.

The Fourth Circuit on Monday issued an opinion reversing and remanding the discrimination case of former Deputy U.S. Marshal Phillip Cochran and holding that a timely motion for reconsideration delays the running of the 90-day limitations period.
