ABA Lobbies High Court On Attorney-Client Privilege

Law360, New York (May 5, 2009, 12:00 AM EDT) -- The American Bar Association has requested that the U.S. Supreme Court rule that litigants have an immediate right to appeal court rulings that they have waived attorney-client privilege and that compel them to disclose the otherwise privileged documents.

In an amicus curiae brief filed Monday in Mohawk Industries Inc. v. Carpenter, the ABA requested that the court overturn the judgment of the U.S. Court of Appeals for the Eleventh Circuit and rule that a party has a right to immediate appeal under the collateral order doctrine....
