A former carpenters union delegate and shop steward who lost his union gig for collecting benefit contributions from his employer when cell phone data showed him away from the job site told a three-judge panel of the Second Circuit Monday that the subpoena for his phone records was unlawful and that a district court order that allowed his ouster to stand should be reversed.
