A federal judge has dismissed without prejudice a putative class action brought by employee health funds accusing Walgreen Co., CVS Pharmacy Inc., Wal-Mart Stores Inc. and others of overcharging customers for generic drugs.

CVS Pharmacy Inc., Walgreen Co., Wal-Mart Stores Inc. and others have asked a judge to dismiss a proposed class action accusing them of overcharging for generic drugs by not passing along discounts to consumers.

Two Minnesota-based employee health funds have accused CVS Pharmacy Inc., Walgreen Co., Wal-Mart Stores Inc. and other pharmacies of overcharging customers for generic drugs, illegally hiking up prices instead of passing on the discounts they receive in the acquisition of generics to consumers.
