    The Fourth Circuit said a peanut company whose storage facility caught fire and exploded after pesticides were misapplied can't sue its extermination company for $19 million in losses because the contract excluded liability for consequential damages, affirming a North Carolina federal court's ruling on Wednesday.

    Peanut Co. Sues Fumigator Over $19M In Fire Damages

    Severn Peanut Co. Inc. launched a negligence and breach of contract suit on Friday alleging Industrial Fumigant Co. is responsible for more than $19 million in damages after its efforts to fumigate Severn's North Carolina storage facility in 2009 led to an explosion and fire.
