A food-container-part maker can't put off the damages phase of a patent dispute with Invista North America pending a decision from the U.S. Patent and Trademark Office, according to a Wednesday order from a Delaware federal judge who said analyzing the motion was like being "transported to Alice in Wonderland territory."

The Federal Circuit on Wednesday affirmed a Delaware federal judge's determination that food packaging component manufacturer M&G Polymers USA LLC indirectly infringed an Invista North America patent for a container component that limits gas circulation, letting stand an injunction that blocks the manufacturing of the infringing product.
