The Federal Deposit Insurance Corp. dropped its suit seeking $170 million in tax refunds from AmFin Financial Corp. now that the reorganized bank has agreed to fork over the money, allowing an Ohio federal judge to close the case on Friday.

AmFin Financial Corp. on Monday told an Ohio federal court that state law does not allow the Federal Deposit Insurance Corp. to establish a specific trust to turn over a $170 million tax refund that the FDIC says is its property.
