A data technology company started by two brothers and former EMC Corp. employees will appeal to the Federal Circuit a judge's recent upholding of a Delaware federal jury's "logically incomprehensible" ruling that the entity infringed four data protection technology patents held by the siblings' former employer.

A Delaware federal judge has reluctantly ruled that a verdict that a company founded by two former EMC Corp. employees infringed EMC's patents must stand, even though some of the jury's findings are "logically incomprehensible," because the problem was not identified until it was too late.
