A former Cognate Bioservices Inc. president and CEO on Thursday escaped a trade secrets theft suit filed against him by the company after a Maryland federal judge ruled that the allegations had already been argued and decided in state court.

Cognate Bioservices Inc. said its former president and CEO stole its trade secrets after he resigned, handing the information over to his new employer and helping him start a consulting firm rivaling Cognate, according to a suit filed Wednesday in Maryland federal court.
