A New York federal judge on Wednesday tossed a consumer protection suit accusing Darden Restaurants Inc. of illegally charging mandatory gratuities and using deceptive pricing at popular Times Square restaurants, finding the restaurant customers who brought the case failed to properly state a claim.

TGI Friday's, Other NYC Eateries Settle Price-Fixing Suit
A customer who accused a slew of New York City restaurants of engaging in a price-fixing conspiracy by illegally adding automatic gratuities has settled with TGI Friday's and other eateries, but he won't back down against the other restaurants that have refused to change their billing policies, his attorney told Law360 on Wednesday.
