The low statutory bar for U.S. federal agencies to invoke sovereign immunity may prevent a nonprofit industry group overseen by the Federal Energy Regulatory Commission from imposing fines on the government's federal agencies for not meeting electrical grid reliability standards, two judges on the D.C. Circuit suggested on Friday.

The Federal Energy Regulatory Commission told the D.C. Circuit on Tuesday that the Federal Power Act authorizes a nonprofit industry group overseeing the nation's electric grids to fine all users, owners and operators of bulk-power systems, including federal agencies, for not meeting reliability standards.
