Patent holding company Evolutionary Intelligence LLC said Tuesday it intends to appeal to the Federal Circuit the recent dismissal of its claims that Facebook Inc., Apple Inc. and other tech giants infringed its data management patents, which were found not to pass the test set by the landmark Alice ruling.

Apple Inc., Facebook Inc., Yelp Inc. and a host of other big-name tech companies urged a California federal judge Tuesday to throw out Evolutionary Intelligence LLC's lawsuits accusing them of infringing two patents on data management, arguing that the patents are invalid under Alice.

A California federal judge on Friday agreed to stay a patent case against Sprint Nextel Corp. pending the outcome of inter partes reviews of the patents sought by other companies, provided Sprint doesn't pursue the same invalidity theories used in the reviews if the patents survive.
