A California federal judge refused Monday to dismiss shareholder derivative claims against Intuitive Surgical Inc. directors that flow from allegedly deadly problems with its high-tech surgical system, finding a "combination of widespread and enduring impropriety" excused shareholders from demanding redress from the board before suing.
