A New Jersey federal judge threw out a proposed class action against BlackBerry Corp. on Wednesday, saying the phone's inability to sync contacts lists with other devices isn't a breach of implied warranty because the defect doesn't make a smartphone unfit for its intended use.

A New Jersey federal judge on Tuesday shot down a putative class action against BlackBerry Corp. over alleged defects in its 10 series smartphones after ruling that the aggrieved consumer behind the suit fell short in identifying purported misrepresentations by the company and his reliance on them.
