An Illinois federal judge on Tuesday found that Old Republic Insurance Co. owes indemnification but not defense costs to a federal contractor found responsible for a leaky flood control tunnel, saying that although the contractor was covered under its subcontractor's policy, the agency proceeding in which it was found liable was not a trial.
