PNC Bank NA has agreed to pay $16 million to settle Fair Labor Standards Act claims brought by a collective of mortgage loan officers who claim they were denied overtime pay and a proper commission, according to settlement documents filed in Pennsylvania federal court Thursday.

PNC Bank NA won't be able to argue that a collective of mortgage loan officers were exempt from the Fair Labor Standards Act's overtime requirements, a Pennsylvania federal judge said Friday, finding the bank had previously described the employees as non-exempt.

A Pennsylvania federal judge on Wednesday conditionally certified a collective action in a lawsuit accusing PNC Bank NA of failing to pay its mortgage loan officers adequate overtime and of not paying them for all the hours they worked.
