A hospital that indirectly purchased a generic of the blood clot drug Lovenox can request declaratory relief in a proposed class action accusing Momenta Pharmaceuticals Inc. and Sandoz Inc. of conspiring to monopolize the drug's market, but can't seek damages, a Tennessee federal judge said Tuesday.

A Tennessee federal magistrate judge on Thursday recommended that a proposed class action accusing Momenta Pharmaceuticals Inc. and Sandoz Inc. of conspiring to monopolize the market for a generic of the blood clot drug Lovenox should stand, as a hospital sufficiently alleged that the companies manipulated the organization that sets quality testing standards.

Momenta Pharmaceuticals and Sandoz have been hit with a proposed antitrust class action by a Tennessee hospital alleging they conspired to monopolize the market for a generic version of the blood clot drug Lovenox by manipulating testing standards to ensure a Momenta testing patent would block other competitors.
