A group of Mercedes owners alleging that their diesel-engine Benzes use Volkswagen-style "defeat devices" to get around emissions tests and are actually big polluters asked a New Jersey federal judge on Friday not to dismiss their suit, saying they have appropriately pled all their claims.

A New Jersey federal judge on Thursday appointed Carella Byrne Cecchi Olstein Brody & Agnello PC and Hagens Berman Sobol Shapiro LLP as interim class counsel in a suit alleging several Mercedes-Benz diesel models use Volkswagen-style "defeat devices."

The U.S. Environmental Protection Agency has asked Daimler to explain emissions levels in certain Mercedes-Benz diesel vehicles after a proposed class action alleged they use Volkswagen-style "defeat devices" to ace emissions inspections, a Daimler representative confirmed Monday.
