A Mississippi federal court has refused to disqualify an attorney who is helping Meritor Inc., Boeing Co. and Rockwell Automation Inc. fight accusations by homeowners that their property was damaged by toxic chemicals that were dumped from a nearby automotive parts plant.

Homeowners accusing Meritor Inc., the Boeing Co., Rockwell Automation Inc. and Textron Inc. of property damage caused by the dumping of toxic chemicals near their homes sought Wednesday to disqualify Meritor's lead counsel, saying they need to call him as a witness at trial.

Michigan-based auto parts manufacturer Meritor Inc. and its affiliate Rockwell International Corp. were smacked Thursday with multiple suits in Mississippi federal court by homeowners claiming their properties have been made worthless by Rockwell's past dumping of toxic chemicals near their homes.
