A California federal judge on Thursday agreed to toss a lawsuit accusing the U.S. Environmental Protection Agency of violating the law and weakening water quality in the San Francisco Bay area by dodging its duties to review state regulators' changes to water standards.

The Environmental Protection Agency asked a California federal judge on Friday for time to go back and determine whether relaxed water standards initiated by state regulators during a drought were considered “revised” rules subject to EPA review before moving forward in a lawsuit accusing the agency of shirking its duty to monitor water quality regulations, saying the agency has more expertise on the matter than the court.

The EPA can’t escape a suit brought by the Natural Resources Defense Council alleging the agency harms water quality in the San Francisco Bay area by dodging its duty to review state regulators’ temporary changes to water standards during drought conditions, a California federal judge said on Tuesday.
