A Texas hospital on Wednesday blasted an attempt by AT&T Services Inc. to throw out an Employee Retirement Income Security Act lawsuit alleging AT&T had schemed with United HealthCare Services Inc. to embezzle benefits payments.

AT&T on Wednesday told a federal judge in Texas to dismiss a complaint brought by RedOak Hospital LLC alleging that it violated the Employee Retirement Income Security Act, because the "elaborate scheme" it alleges exists — whereby the hospital was stiffed on patient bills — is nothing more than an accounting dispute.

A Houston hospital sued AT&T in Texas federal court on Wednesday, accusing the company of violating the Employee Retirement Income Security Act, describing a payment practice between the company's benefits plan and UnitedHealthcare as "an embezzlement scheme" that stiffed the hospital on patient bills.
