A hedge fund fired back Monday against an attempt by securities regulators to dismiss a putative class action claiming they sent money to the wrong shareholders in a defunct drug company, saying a Delaware judge's approval of the bankruptcy plan does not absolve them of their duties.

The Financial Industry Regulatory Authority and the Depository Trust Co. asked a Delaware federal judge on Wednesday to throw out a putative class action that accuses them of sending money to the wrong group of shareholders in a defunct drug company, saying a bankruptcy court has already had the final word on the matter.

A former investor in bankrupt Bind Therapeutics Inc. asked a Delaware federal court on Thursday to halt distributions to the defunct company's shareholders, saying errors by securities clearinghouse the Depository Trust Co. and regulator the Financial Industry Regulatory Authority resulted in the first $8 million payment going to the wrong people.
