A watch distributor locked in a $9.4 million contractual dispute with Timex and a Dutch affiliate asked a New York federal court Thursday to keep the battle in the courts, arguing that its adversaries, which want the dispute settled by Swiss arbitrators, waived that right when they obtained a preliminary injunction against sales.
