A Second Circuit panel on Wednesday shot down a suit alleging Grindr was negligent in failing to stop a former user's ex-boyfriend from using the dating app to stalk and harass that user, finding the tech company is protected by the Communications Decency Act.

A privacy public interest group on Monday urged the Second Circuit to revive a lawsuit accusing Grindr of doing nothing to stop a user from harassing his ex through the app, saying a safe harbor provision for internet platforms in federal communications law doesn't give the company a free pass to ignore reports of abuse.

A man accusing the online dating app Grindr LLC of lacking safety features that would have prevented a "malicious" impersonation scheme by his ex-boyfriend urged the Second Circuit to revive his allegations, saying in a brief made public Wednesday that providers of "interactive computer services" should be liable for fraud by users.
