    A California federal judge tossed a proposed class action alleging Subway's 100% tuna claim is misleading, but refused to sanction counsel representing the lead plaintiff, finding that although her attorneys' alleged discovery misconduct was "blameworthy," the sandwich chain failed to show the consumer recklessly pursued her claims.
