The Cayuga Nation is asking a New York federal court to throw out counterclaims lobbed against it in a suit seeking to bar a group of people and their businesses from selling cannabis illegally on its land, saying as a sovereign nation, it has immunity from those claims.

A New York federal judge has thrown out Racketeer Influenced and Corrupt Organizations Act claims in a suit brought by the Cayuga Nation alleging a group of people conspired to illegally sell cigarettes and cannabis within its territory, saying the nation hasn't established the level of harm needed to support the claims.

A New York federal judge has denied a bid to dismiss a Racketeer Influenced and Corrupt Organizations Act suit the Cayuga Nation filed alleging a group of people illegally sold marijuana and cigarettes in violation of Cayuga Nation law, but stayed the case while a parallel suit in the tribe's courts runs its course.
