A Colorado federal judge on Tuesday ruled that discovery will continue in a proposed class action alleging the Colorado state treasurer unconstitutionally seized and sold their property, regardless of a pending motion to dismiss the case.

A Colorado federal judge on Friday tossed a proposed class action brought by two men alleging their rights were violated by state treasury officials because they did not get notice about the seizure and sale of abandoned property, pointing out that the plaintiffs never said they actually filed claims to recover property.
