Order on Motion to Consolidate Cases
TEXT ORDER granting Defendants consent Motion to Consolidate (DE 14 ). Defendant moves to consolidate these actions pursuant to Rule 42(a) of the Federal Rules of Civil Procedure. (DE 14 .) Plaintiff has filed a response indicating that it does not oppose consolidation. (DE 15 .) Rule 42(a) permits a court to consolidate actions that involve common questions of law or fact. The Court has broad discretion in determining whether consolidation is appropriate. These two cases arise from the same employment relationship between the parties and the same events surrounding Defendants termination. They present substantially overlapping factual allegations, legal issues, witnesses, and evidence. Consolidation will promote judicial economy, reduce duplication of effort, minimize expense to the parties, and avoid the risk of inconsistent rulings. The Court further finds that consolidation will not result in prejudice or juror confusion. Accordingly, the motion is GRANTED. Civil Action No. 4:25-cv-12944-JD is designated as the lead case. Civil Action No. 4:26-cv-00050-JD is consolidated into the lead case for all purposes, including trial. All future filings shall be made in the lead case only. The Clerk is directed to close Civil Action No. 4:26-cv-00050-JD administratively. The administrative closure does not constitute a dismissal of any claim; all claims shall proceed in the lead case.
