Defendants seek to file two ground leases under seal "because they are contracts between the Government and Defendants for the operation, maintenance and management of military housing that contain confidential information related to the Government's proprietary business operations and further disclose how these businesses are structured and run, how they are financed, and how Defendants are to execute these Government contracts," rather than "housing or other services provided to the general public." ECF No. 63 at 3, 5. In support of their motion Defendants cite two, out-of-circuit cases. See id. at 3-4 (citing Doe v. Camp Pendleton, 2020 WL 1890576 (S.D. Cal. Apr. 16, 2020) and Driver v. Balfour Beatty Communities, Case No. CIV-20-55-D (W.D. Okla. July 20, 2020)). But the Fifth Circuit has cautioned that, in reviewing motions to seal, district courts must be "ungenerous" and conduct a "line-by-line" balancing of the public's right of access against interests favoring nondisclosure. Binh Hoa Le v. Exeter Fin. Corp., 990 F.3d 410, 418 (5th Cir. 2021). Despite Defendants' contention to the contrary, the fact that that these contracts concern military housingpresumably funded by taxpayerscounsels in favor of public access to these contracts.
