ORDER terminating 11 Motion to Dismiss: In view of the Amended Complaint and Plaintiff's proposal to file a Second Amended Complaint [D.E. 24], the motion to dismiss is terminated as moot. As concerns the parties' proposed stipulation filed on June 29, 2026 [D.E. 24], it appears that the parties propose to stipulate to a briefing schedule for Plaintiff to move to file a Second Amended Complaint, followed by a briefing schedule for Defendant to move to dismiss the Second Amended Complaint. In the interests of efficiency and preservation of scarce judicial resources, and given that both motions likely will turn on the same standard (i.e., whether the well pleaded allegations of the Second Amended Complaint state a legally viable claim), the parties are asked to consider stipulating to the filing of the Second Amended Complaint, followed by Defendant's Rule 12 motion.
