Paperless Order re: Plaintiffs' Motion For Award of Taxable Costs 564 . Plaintiffs' motion requests costs related to subpoenas, transcripts, witness fees, etc. Defendants argued that Plaintiffs failed to sufficiently justify the cost of the non-party subpoenas and transcripts acquired. [ECF No. 569 ]. Plaintiffs addressed these omitted points for the first time in their reply. [ECF No. 570 ].
The Court does not address arguments made for the first time in a reply. Silberman v. Miami Dade Transit, 927 F.3d 1123, n. 6 (11th Cir. 2019) (noting that defendant did not "have an opportunity to respond to either of [plaintiff's] newly-raised theories of liability" and declining to address arguments raised for the first time in a reply). However, because Plaintiffs' additions are, in effect, related to explanations rather than arguments, the Undersigned will permit Defendants to file a supplemental memorandum responding to Plaintiffs' newly-asserted points related to service of process and deposition transcripts. If Defendants choose to file this supplemental memorandum, then it must be filed on CM/ECF by Thursday, May 2, 2024. This filing must be double-spaced and shall not exceed six (6) pages, excluding the signature block and certificate of service. No other briefing is permitted outside of a Court Order.
