   ORDER denying 3 Emergency Motion for Temporary Restraining Order. Rule 65(b)(1) of the Federal Rules of Civil Procedure empowers a court to “issue a temporary restraining order without written or oral notice to the adverse party or its attorney only if: (A) specific facts in an affidavit or a verified complaint clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition; and (B) the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required.” These requirements are stringent and must be scrupulously honored. Fed. Trade Comm'n v. Grand Teton Pros., LLC, No. 19-CV-933 (VAB), 2019 WL 4439501, at *2 (D. Conn. June 18, 2019). Here, Defendants have not yet received notice of the complaint, as the in forma pauperis process is ongoing. Further, Plaintiff did not certify in writing the reasons why notice should not be required, as required by Rule 65(b)(1)(B). Moreover, Plaintiff does not point to “specific facts” showing that an irreparable injury will occur “before the adverse party can be heard in opposition.” Fed. R. Civ. P. 65(b)(1)(A). Accordingly, there is no indication that the alleged injury is so immediate as to require ex parte proceedings.
