Order on Motion for Cost and Fees
ORDER denying 41 Plaintiff's motion to waive PACER fees. Under the Judicial Conference's Electronic Public Access Fee Schedule, PACER fees apply to all parties and are "necessary to reimburse expenses incurred by the judiciary in providing electronic records." See https://www.uscourts.gov/services-forms/fees/electronic-public-access-fee-schedule (published Dec. 31, 2019). Courts may grant exemptions from PACER's fees to individuals who "have demonstrated that an exemption is necessary to avoid unreasonable burdens and promote public access to information." Id. The individual receiving the exemption "must agree not to sell the data obtained as a result and must not transfer any data obtained as a result of the free exemption," and the exemption must be "granted for a definite period of time, should be limited in scope, and may be revoked at the discretion of the court granting the exemption." Id.
Although Plaintiff may be indigent, the Court cannot find that PACER fee exemption is warranted. Document access in PACER costs $.10 per page up to a maximum of $3.00 per document. Users are charged only if they accrue more than $30 in the previous quarter, and 75% of PACER users fall below that quarterly threshold. Further, because the Court has granted Plaintiff's motion to participate in electronic filing, see ECF No. 11, she may view the PDFs attached to emails she receives when there is a filing. PACER fees can be avoided if she prints at the time of the first review any document she wishes to review again.
To the extent Plaintiff seeks exemption from fees charged by Lexis Nexis and Westlaw, the Court is without power to waive fees charged by those private companies.
