ORDER granting 17 Motion to Amend Order on Motion for Entry of Default. The default entered as to Party-in-Interest State of Maine Department of Transportation only (ECF No. 16) is hereby VACATED. State of Maine Department of Transportation duly and timely answered the Plaintiff's Complaint on July 1, 2026 (ECF No. 5) and thus, the motion seeking entry of default and the entry of default against State of Maine Department of Transportation were in error. The present Motion to Amend the order of entry of default clearly within the body of the Motion itself seeks to address the errors and confirm that default is only appropriate as to two other parties-in-interest, despite the Motion's caption and attachment of service documents continuing to reference State of Maine Department of Transportation (likely all carried over from an earlier copied and pasted filing). ECF No. 16 stands insofar as DEFAULT is ENTERED against Parties-in-Interest Consolidated Communications of Northern New England LLC and TD Bank North America only, as those two interested parties have been served and have not thereafter appeared within the time required by law.
