Order on Motion to Alter Judgment
Order DENYING 69 Letter MOTION to Alter Judgment Discharge Final Judgment (the "Motion"). Defendant seeks relief from the final judgment under Rule 60(b), "a mechanism for 'extraordinary judicial relief' invoked only if the moving party demonstrates 'exceptional circumstances.'" See Ruotolo v. City of New York, 514 F.3d 184, 191 (2d Cir. 2008) (further citation omitted). Such circumstances are not met here. Defendant has not provided actual evidence that the judgment has been satisfied, such as documentation that a payment was cleared. The email chain submitted here does not suffice to demonstrate this; it simply confirms receipt of a check. Moreover, even if such evidence had been provided, the Court would not be prepared to grant such "extraordinary judicial relief" on the basis of a two-page Letter Motion that does not clearly demonstrate how Defendant is entitled to such relief. So Ordered by Judge Joanna Seybert on 6/11/2026. (CG)
