Stipulation and Order of Voluntary Dismissal
STIPULATION AND ORDER FOR DISMISSAL WITH PREJUDICE. IT IS HEREBY STIPULATED AND AGREED, by and between the attorneys for the respective parties hereto, pursuant to Fed. R. Civ. P. 41(a), that the above-captioned action be and is hereby dismissed with prejudice without attorneys' fees, costs, or expenses, to any party, and that the Temporary Restraining Order dated December 7, 2015, to the extent still in force, be vacated; and IT IS HEREBY FURTHER STIPULATED AND AGREED, that this Stipulation may be filed without further notice and, for purposes of filing this Stipulation, this Stipulation may be executed in counterparts, which, when taken together, shall constitute the entire Agreement, and that signatures by facsimile and electronic mail should be considered by the Court the same as original signatures. Order of Discontinuance
ORDER: The Court having been advised that all claims asserted herein have been settled, it is ORDERED, that the above-entitled action be and hereby is discontinued, without costs to either party, subject to reopening should the settlement not be consummated within thirty (30) days of the date hereof. The parties are advised that if they wish the Court to retain jurisdiction in this matter for purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the next thirty (30) days with a request that the agreement be "so ordered" by the Court.
