Order on Motion for Preliminary Injunction Order on Motion to Expedite
TEXT ORDER: This matter is before the court on Plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction, ECF No. 3, and Plaintiff's Motion to Expedite Discovery, ECF No. 21. The court held a hearing on Plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction and issued an Order granting the Motion in part as to Plaintiff's Motion for TRO only. [ECF No. 29.] Following the hearing, the parties submitted a joint discovery plan to the court via email in anticipation of a hearing on Plaintiff's Motion for Preliminary Injunction. Prior to the Preliminary Injunction hearing, the parties submitted a Joint Motion for Preliminary Injunction in which they agreed to extend the terms of the TRO through February 25, 2023. [ECF No. 40.] The court granted this motion, ECF No. 41, and the hearing was cancelled, ECF No. 39. Because the parties agreed upon a discovery plan, the court finds the issue of Plaintiff's Motion for Expedited Discovery, ECF No. 21, is MOOT and the Motion is DISMISSED. Furthermore, in light of the court granting the parties' Joint Motion for Preliminary Injunction, the court finds the remaining portion of Plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction is also moot. Therefore, Plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction, ECF No. 3, is DISMISSED AS MOOT as to the request for preliminary injunction.
