ORDER denying 292 Letter Motion to Stay. Having reviewed the parties' submissions, the Court ORDERS the following: (1) The parties shall proceed with depositions. Any deposition can be reopened if additional discovery that was previously ord ered to be produced is produced at a later date. (2) At this juncture, Mr. Washington continues to be in contempt: he has not produced the phone that he was ordered to produced-the phone that was provided to him by EVEN. See ECF No. 285 at 3. Accordi ngly, fines will continue to accrue unless and until Mr. Washington provides the phone (that EVEN provided him) to the U.S. Marshals as previously instructed. See ECF No. 285. (3) With regard to the laptop, the Court remains skeptical of Mr. Washingt on's excuse that he lost the laptop-including that he did not initially provide proof of his canceled Uber, that he provided redacted messages, and that the timing of his story is suspicious. See, e.g., ECF No. 300-1 at 14-19. As such, the Court agrees with the EVEN Defendants that a hearing, in which Mr. Washington will be questioned under oath, is appropriate. See ECF No. 304 at 6. Counsel for all parties and Mr. Washington are therefore ordered to appear at an in-person hearing on Septem ber 21, 2026, at 2:30 p.m. in Courtroom 320 of the Charles L. Brieant Jr. Federal Building and United States Courthouse, 300 Quarropas Street, White Plains, New York 10601-4150. Mr. Washington shall arrange and pay for his own travel. Any party seek ing an adjournment must do so no later than September 7, 2026, at 2:30 p.m. The parties should also be prepared to discuss the EVEN Defendants' motion for case-terminating sanctions. See ECF No. 252. Finally, Mr. Washington's prior request to stay the accrual of sanctions and fines-made through counsel, before his counsel withdrew-is denied. See ECF No. 292.
