STIPULATION AND ORDER OF DISMISSAL: Pursuant to Rule 41(a)(1)(A) of the Federal Rules of Civil Procedure and the qui tam provisions of the False Claims Act, 31 U.S.C. § 3730(b)(1), and subject to the terms and conditions of the September 2023 Settlement Agreement ("Settlement Agreement") between theUnited States, Relator Samuel Caughron, and Defendant Genomic Health Inc. ("GHI"), the United States and Relator Caughron hereby: (1) dismiss with prejudice all monetary claims on behalf of the United States against GHI for the Covered Conduct as defined in Recitals Paragraph D of the Settlement Agreement. Genomic Health, Inc. et al., 17-CV- 4460, filed on May 11, 2018 (the "DOE Action"), shall be unsealed; The Amended Stipulation and Order in both the Caughron and DOE Actions (16-CV-4038 and 17-cv-4460), dated June 13, 2023, and So Ordered on June 16, 2023, shall be unsealed; The September 12, 2023 letter to the Court from the United States and its enclosures shall be unsealed, which enclosures are: The Notice of Intervention in the Caughron Action (16-CV-4038) shall be unsealed; The Notice of Intervention in the DOE Action (17-cv-4460) shall be unsealed; The Stipulation of Dismissal in the Caughron Action (16-CV-4038) shall be unsealed; The Stipulation of Dismissal in the DOE Action (17-cv-4460) shall be unsealed; The instant Order in both the Caughron and DOE Actions (16-CV-4038 and 17-cv-4460) shall be unsealed; Any document filed in the Caughron Action (16-CV-4038) after the date of unsealing shall be unsealed; Any document filed in the DOE Action (17-cv-4460) after the date of unsealing shall be unsealed; All other contents of the Courts file in the Caughron Action (16-CV-4038) shall remain under seal and not be made public; All other contents of the Courts file in the DOE Action (17-cv-4460) shall remain under seal and not be made public.
