Minute Order Order on Stipulation
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 9/22/2026.
Re: 65 Stipulation Governing Confidential Documents and Information.
Parties are permitted to agree to discovery procedures, including confidentiality protections, without judicial approval. See Fed. R. Civ. P. 29(b); see also Cross v. Walmart, Inc., 350 F.R.D. 395, 398-99 (D. Nev. 2025). The stipulation does not explain in meaningful fashion why judicial oversight is required as to the parties' discovery agreement. This is particularly true because, in the event the parties seek to file information they deem confidential, the Federal Rules of Civil Procedure, Local Rules, and Ninth Circuit caselaw already provide mechanisms for the parties to request to protect that information. See Fed. R. Civ. P. 5.2; see Local Rule 10-5; see Kamakana v. City and County of Honolulu, 447 F.3d 1172 (9th Cir. 2006); see Ctr. for Auto Safety v. Chrysler Group, LLC, 809 F.3d 1092 (9th Cir. 2016).
IT IS THEREFORE ORDERED that the stipulation governing confidential documents and information (ECF No. 65 ) is denied without prejudice.
