Turbocam states that the declaration at issue is only relevant to defend against liability for a mixed-motives claim under 42 U.S.C. 2000e-2(m). The court does not read Bernier's complaint or her summary judgment briefing as attempting to raise such a claim. As the declaration is not relevant to any issues to be addressed at summary judgment, Bernier's motion to strike (doc. no. 97) is denied as moot. So Ordered by Judge Landya B. McCafferty.(de)
