Order on Motion for Summary Judgment
ORDER: (1) GRANTING PLAINTIFFS HELICOPTER ASSOCIATION INTERNATIONAL AND SAFARI AVIATION, INC. d/b/a SAFARI HELICOPTERS HAWAII'S AMENDED MOTION FOR SUMMARY JUDGMENT; AND (2) DENYING DEFENDANT EDWIN SNIFFEN'S MOTION FOR SUMMARY JUDGMENT re 48 , 58 - Signed by MAGISTRATE JUDGE KENNETH J. MANSFIELD on 7/22/2024. Based on the foregoing, the Court GRANTS Plaintiffs' Amended Motion for Summary Judgment (ECF No. 58) and DENIES Defendant's Motion for Summary Judgment (ECF No. 48). The Court finds that federal law preempts the monthly reporting requirements in HRS § 261-12(b)(8). The Court also GRANTS Plaintiffs' request for a permanent injunction. Defendant is hereby ENJOINED from enforcing the monthly reporting requirements set forth in HRS § 261- 12(b)(8). The permanent injunction shall take effect upon entry of this Order and shall remain in full force and effect unless otherwise ordered. (eta)
