The Court makes preliminary remarks and hears from parties as to the 70 Motion to Stay, the 83 Motion for Required Status Reports and the 118 Objection to the Magistrates Order.
The Court enters findings on the record and:IT IS HEREBY ORDERED the 70 Motion to Stay is GRANTED pending the outcome of the ongoing criminal case for the reasons stated on the record.IT IS FURTHER ORDERED Defendants Uprise and Kromer shall file a Status Report within 30 days of the resolution of the underlying criminal matter.IT IS FURTHER ORDERED Parties shall file a notice or motion(s) to lift the stay within 30 days of the resolution of the underlying criminal matter.IT IS FURTHER ORDERED the 118 Objection to the 111 Magistrate Judges order Denying the Motion to Sever is OVERRULED and DENIED for the reasons stated on the record. FINALLY IT IS ORDERED all other pending motions in this case are DENIED without prejudice at this time. Parties are granted leave to re-file these motions if and when the stay is lifted. Parties are also granted leave to file a motion(s) to reopen discovery as needed.
The Court will not issue a separate written ruling. The instant minutes of proceedings and minute order(s), which incorporate by reference the transcript of the hearing and the reasoning therein, shall serve as the final order of the Court.
