   Minute Order Terminate Motion Order on Motion to Seal Order on Report and Recommendation

   MINUTE ORDER IN CHAMBERS of the Honorable District Judge Anne R. Traum on 10/5/2026.

   The Magistrate Judge has issued a Report and Recommendation (ECF No. 1221 ) that recommends denying Plaintiff's and Counter Defendants' Motions to Seal (ECF Nos. 1188 , 1195 ) for failure to address the governing standard. The Magistrate Judge also recommends providing the opportunity to file renewed motions and that the documents at issue remain temporarily under seal until the adjudication of the renewed motions, if filed. The deadline to object to the Report and Recommendation has passed. Because no party objected, the Court conducts no review of the Report and Recommendation and adopts it in full. Thomas v. Arn, 474 U.S. 140, 149 (1985).

   It is therefore ordered that the Report and Recommendation is ADOPTED. (ECF No. 1221 .)

   It is further ordered that the motions to seal are DENIED without prejudice. (ECF Nos. 1188 , 1195 .) Plaintiff and Counter Defendants have 45 days, until November 19, 2026, to file renewed motions to seal.

   It is further ordered that the documents at issue (ECF Nos. 1190 , 1197 ) remain temporarily under seal pending the resolution of the renewed motions, if filed. If Plaintiff and Counter Defendants do not file timely renewed motions as directed, the documents will be unsealed.

   Report and Recommendation

   REPORT AND RECOMMENDATION TO DENY WITHOUT PREJUDICE MOTIONS TO SEAL (ECF NOS. 1188, 1195).

   I RECOMMEND that plaintiff and counter defendants' motions to seal at ECF Nos. 1188, 1195 be DENIED without prejudice with leave to refile within 45 days a new motion to seal that addresses the "compelling reasons" sealing standard.

   I FURTHER RECOMMEND:

   1. that the documents at issue (ECF Nos. 1190 and 1197 ) remain temporarily under seal pending resolution of the parties renewed motions to seal and;

   2. that if the parties do not timely file renewed motions as directed here, the documents be unsealed.

   Objections to R&R are due by 9/14/2026.
