MINUTE ORDER: The Plaintiff has filed a series of miscellaneous motions on the docket in the wake of this Court's 19 20 Memorandum Opinion and Order granting Defendant Shellpoint Mortgage Servicing's Motion to Dismiss and dismissing claims against Defendants Shellpoint and LoanDepot.com LLC. The Court addresses or resolves each motion as follows. First, the Court construes Mr. Washington's 21 filing as either a Motion to Alter or Amend the Judgment under Fed. R. Civ. P. 59 or a Motion for Reconsideration under Fed. R. Civ. P. 60. Defendant Shellpoint Mortgage Servicing is directed to respond to the 21 Motion by July 31, 2026. Any reply by Mr. Washington in support of the 21 Motion shall be due by August 14, 2026. Second, the arguments advanced in Mr. Washington's 25 "Motion for Hearing" appear to be essentially duplicative of his 21 post-judgment motion. The Court therefore STRIKES that motion and further notes that a hearing on the 21 motion will be scheduled only if the Court determines that one is required under Local Civil Rule 7(f) or another relevant authority. Third, Mr. Washington has filed a 29 Motion for Entry of Default as to Defendant LoanDepot.com, LLC. The Court hereby DENIES the motion for default because the claims against LoanDepot.com, LLC have already been dismissed pursuant to the Court's 19 Order. Finally, the Court will accept no further filings from Mr. Washington regarding its 19 20 Memorandum Opinion and Order until Defendant Shellpoint Mortgage Servicing's response is filed. SO ORDERED. ORDER signed by MAG/JUDGE JOI ELIZABETH PEAKE on 07/08/2026, that Plaintiff's Motions to Remand [Doc. # 29 , # 18 , # 17 , # 12 ] are DENIED. FURTHER ORDERED that Defendants' Motion to Dismiss [Doc. # 19 ] filed in the Eastern District is terminated without prejudice to re-filing in this Court. Defendants' new deadline to answer or to move for dismissal is August 7, 2026. FURTHER ORDERED that Plaintiff's prior Rule 26(f) Report [Doc. # 25 ], filed in the Eastern District, is terminated, and discovery will be addressed after the resolution of any motions to dismiss. FURTHER ORDERED that if Plaintiff intends to bring claims as a representative of another person or entity, he must promptly retain counsel. If he is proceeding pro se, he may only bring claims on his own behalf or as the sole beneficiary. (at)
