ENDORSED ORDER denying without prejudice 97 Motion for Hearing / Conference. The Court appreciates that the parties would like to have a telephone conference to discuss trial dates. However, it is not necessary. The person to coordinate with is the Courtroom Deputy and the Court understands that there have been multiple communications between her and counsel. Because of speedy trial issues with criminal cases, the Court will be unable to try this case in June. Indeed, the parties informed the Court that they were unavailable for three weeks in June, almost necessitating a July trial date. However, the Court will be able to try this case in July. As the Court has said, it does not provide dates certain. If the parties need a date certain they can consent to jurisdiction before the magistrate judge. The parties were so informed of this option multiple times during the litigation, including during the pretrial conference. In reviewing the Court's calendar, the Court may be able to try this case the week of July 20. But it is the courtroom deputy who knows the criminal cases that need to be scheduled with priority and the dates that those parties are available. The undersigned judge is in trial next week and will be in trial part of the following week. The Court is unable to accommodate the request for a hearing at this time, and as noted above, it really is not needed. Contact and communication with the Courtroom Deputy is the best way to proceed.
